Blue Seal Equipment Warranty
Effective date: 1st January 2025
Blue Seal Limited (company number 03437267 and UK establishment number BR003292) which has its registered office at Unit 67 Gravelly Industrial Park, Erdington, Birmingham, West Midlands, B24 8TQ (“Blue Seal”), gives its customers a warranty for Blue Seal products purchased from Blue Seal or an authorised Blue Seal seller.
This document explains the terms and conditions of the Blue Seal warranty and your responsibilities as the purchaser of the product. Please read these terms carefully before requesting repair for your product.
For the purposes of this warranty, you are a ‘consumer’ if you have bought products from Blue Seal as an individual for purposes wholly or mainly outside of your trade, business, craft or profession. As a consumer, you have legal rights in relation to products that are faulty or which are not provided as described. Advice about your legal rights is available from your local Citizen’s Advice Bureau. This Blue Seal warranty is given in addition to your legal rights and does not affect your legal rights if there is something wrong with your product.
Buyer's Responsibility
You are responsible for ensuring that your product has been operated, maintained and installed in accordance with the Blue Seal instructions supplied at the time you made your purchase.
Before you request repair to the equipment under this warranty, please check that you have met the conditions below regarding operation and installation, as failure to do so may mean that the faults or problems with your product are not covered by this warranty. Please note that if you request the repair of faults or problems which are not covered by this warranty, (and are not otherwise covered by your legal rights) you will be required to pay a fee to Blue Seal for such repairs. You will be told what this fee is before any work starts.
· OPERATION: Make sure your equipment is operated and maintained in accordance with the instructions in the supplied manuals.
· INSTALLATION: Make sure your product is correctly installed following the instructions in the supplied manuals. This includes correct connection of services such as: electricity, gas, water, drainage, and any required chemicals. [If you have used an approved Blue Seal technician for installation, you will have complied with this requirement.]
What this warranty covers
Blue Seal warrants to the buyer that all products (excluding spare parts) supplied by Blue Seal will be free from defects in materials and workmanship for a warranty period of 12 months from the date of despatch. For spare parts supplied by Blue Seal, Blue Seal warrants to the buyer that such spare parts will be free from defects in materials and workmanship for a warranty period of 90 days from the date of despatch.
This warranty is subject to the following conditions:
· The warranty period does not re-set if a repair or replacement takes place, and the customer would only be entitled to the remaining period from the original despatch date.
· This warranty is not transferable and is only offered to the original buyer.
· This warranty does not extend to any products that have been completely or partially disassembled or that have had unauthorised alterations and modifications made to the product, including missing parts or the fitting of non-genuine Blue Seal parts / components.
· This warranty terms cannot be changed except in writing by an authorised representative of Blue Seal, provided Blue Seal notifies you of such changes.
· This warranty only applies to products purchased from Blue Seal or an authorised Blue Seal seller.
· Any warranty claim must meet the requirements set out below in “How to Make a Warranty Claim”.
· Warranty work must be performed by Blue Seal or by a Blue Seal authorised service provider. Blue Seal will not be held responsible for charges incurred by non-authorised service providers unless Blue Seal has given prior written approval for warranty work to be carried out by a non-authorised service provider.
· Where the product has not been installed by Blue Seal or a Blue Seal authorised service provider, this warranty is only valid if the Blue Seal product is installed by a qualified and licenced person and the product has been installed to meet all manufacturer instructions and any relevant regulations.
What this warranty does not cover
This warranty does not cover normal or scheduled maintenance of the product, nor does it cover the replacement of consumable items such as glass, ceramics, globes, seals, belts, water filters, and fuses or the resetting of the safety devices such as circuit breakers and clearing of drains.
This warranty will not apply to a defect or fault to the extent caused by:
· Improper installation or commissioning of the product. Note that Blue Seal will require reasonable proof that installation has been carried out by a qualified and licenced person if the installation has not been carried out by Blue Seal or a Blue Seal authorised service provider.
· Operation, use or maintenance of the product otherwise than in accordance with the instructions provided by Blue Seal.
· Use of chemicals in relation to the product other than those recommended by Blue Seal.
· Accidental damage, misuse, negligence or any other failure to take reasonable care.
· Use of the product for a purpose or in environmental conditions outside those specified by Blue Seal.
· Damage caused through blocked solenoids or drains and the clearance of blockages.
· Damage caused by and clearance of blockages to pilots, injectors and burners.
· Damage arising from corrosion and/or limescale.
· Parts or items not supplied by Blue Seal, or a Blue Seal authorised service provider.
· Damage caused by rodents or insects.
· Damage caused by movement or transportation by other parties or freight damage where freight has not been paid for by Blue Seal.
· Damage caused by water ingression or incorrect cleaning procedures.
How to make a warranty claim
If a product fails within the warranty period, you should immediately stop using the product and store it in a safe, dry environment and contact Blue Seal as soon as possible. To make a claim under this warranty, contact Blue Seal during the warranty period by telephone on 0121-322-6632. Alternatively, a warranty claim may be submitted in writing at the address set out below.
What Blue Seal will do
For all valid claims under this warranty, Blue Seal will, at its option:
(i) repair the product;
(ii) replace the product with a product that is at least equivalent to the original product in function and
quality; or
(iii) refund you the purchase price. .
Before providing any warranty service, Blue Seal may require you to provide proof of purchase of the product or require responses to questions designed to assist with diagnosing potential faults. All requests must be responded to promptly at the buyer's expense.
No charge will be made for any repair or replacement that falls within the scope of this warranty.
What happens if the work needed is not covered by this warranty
For repair or maintenance services not covered by this warranty, and where you do not have legal rights for a repair, replacement or refund, Blue Seal may require the buyer to provide the buyer's credit card details before providing such warranty services, if the buyer does not have a credit account with Blue Seal. Blue Seal will seek the buyer’s authorisation Blue Seal to charge the buyer's credit card for:
· the reasonable cost of repairs carried out by Blue Seal (including labour costs and the costs of parts) which are not covered by this warranty (including where the exclusions listed above are applicable) or not required to be carried out pursuant to the United Kingdom consumer legislation (if applicable)
· Blue Seal will provide the buyer an estimate of such costs prior to the costs being incurred by Blue Seal, and Blue Seal may ask the customer to enter into a separate services contract for this nonwarranty
work. The buyer acknowledges that the estimates may be given by Blue Seal in stages. For example, Blue Seal may incur travel costs to attend a location before then assessing a product and giving the buyer an estimate of the costs to repair that product. The buyer must notify Blue Seal immediately should further discussion or clarification be required prior to the costs being incurred by Blue Seal.
For all products repairs will be conducted on-site during normal working hours (Mon-Fri 8am-5:00pm).
We will be entitled to charge you our reasonable costs if you do not give us reasonable access to the product for example where Blue Seal is unable to work on the product in situ and it has to be removed from surrounding equipment or benching or excessive waiting time.
The current rates for any additional fees can be obtained from Blue Seal.
